1. Acceptance of Terms

By accessing or using the SAMARTH AI Cognitive Co-Pilot platform ("the Service"), developed and operated by Brix AI ("we", "our", "us"), you agree to be bound by these Terms of Service. If you do not agree, you may not access or use the Service.

The Service is exclusively intended for authorized personnel of the West Bengal Police and related government bodies.

2. Authorized Use

As a user of SAMARTH, you agree to:

  • Use the Service only for lawful, official investigative and procedural purposes.
  • Not share your credentials or grant unauthorized access to the platform.
  • Not attempt to reverse-engineer, decompile, or extract source code from the platform.
  • Report any security vulnerabilities or unauthorized access immediately to your department administrator.

3. AI-Generated Content Disclaimer

SAMARTH provides AI-assisted legal guidance and procedural recommendations based on its three-layered knowledge architecture (Primary Statutes, Departmental Wisdom, and Judicial Guardrails). However:

AI-generated outputs are advisory in nature and do not constitute legal advice. All procedural decisions remain the sole responsibility of the investigating officer. SAMARTH is designed to assist, not replace, human judgment and established chain-of-command protocols.

4. Intellectual Property

All content, features, and functionality of the SAMARTH platform — including but not limited to text, design, graphics, interfaces, code, and the underlying AI models — are owned by Brix AI and are protected under applicable intellectual property laws. Unauthorized reproduction, distribution, or modification of any part of the Service is strictly prohibited.

5. Service Availability

We strive to maintain high availability of the Service. However, we do not guarantee uninterrupted or error-free access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We will make reasonable efforts to notify users of planned downtime in advance.

6. Limitation of Liability

To the fullest extent permitted by law, Brix AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to the use or inability to use the Service. This includes, but is not limited to, damages for loss of data, errors in AI-generated guidance, or service interruptions.

7. Modifications to Terms

We reserve the right to modify these Terms of Service at any time. Changes will be communicated through the platform or via official departmental channels. Continued use of the Service after such modifications constitutes acceptance of the updated terms.

8. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Kolkata, West Bengal.
